That's actually not true. The patent holder is Dayna Decker, and, they license it out to Old Virginia, however, Dayna Decker makes VERY high end candles, with wood wicks and they are actually the innovators of the design.

Yes but the question here is whether or not it IS misappropriation. Only a copyright lawyer, who has access to this particular copyright, and it's "fine print" would be able to say. A copyright is not "all-inclusive." In other words, because Yankee candle has a copyright on "Cotton Candy" for example (don't know whether or not they do), doesn't mean that I can't go out an name a new car model "Cotton Candy." Hence, because he has a copyright on the name, as it applies to music, or drinks, or whatever else he has, doesn't necesarily mean that we can't use that name in candles. Again, only an attorney with access to that particular copyright would be able to tell you for sure, and even then, it would be open to conjecture.

If you wanted to keep the name, you might do a bit of research. Often times, the copyright on a name only applies to a specific industry. In this case, for example, you could not name another SONG "Margaritaville" however, you might still be able to name your bath and body products that. You might look into what that particular copyright says.

I've tried quite a few Ocean Scents, and, I've never tried one better, or with a better throw, than A Garden Eastward's "Salty Mariner." It is everything that Peak's "Ocean" aspires to be.

I thought your point was going to be (and probably should ahve been) that, because of what happened to you, when a supplier that cares enough about their customer chimes in, it is a welcome surprise, and one that we should not take for granted. Instead, you encourage someone that drives these very suppliers away from these boards with their attitude? Go figure.

As stated earlier, though, despite the fact that you doubt me, I will find a way to fall asleep tonight. As for posting stupid questions...well, what can I say? I'm trying to learn as much as I can, as I will be launching a high end candle line near the end of this year. It's my next business venture. This stupid, $6mil per year businessman finds the time...somehow....to post stupid questions, the answers to which will likely help in making me successful. But, again, I think I'll manage to find a way to fall asleep tonight.

I agree with everything you said....Let me know how the Indo Teak turns out. I love this scent, but I couldn't get it to work for me in terms of it's burn quality.

Not sure why that's hard to believe. There are about a half dozen websites in my industry that did MORE than we did last year in sales, two of which are publicly traded companies (perfumania.com and fragrancenet.com). I do understand, though, how, for small minded people, it might be hard to believe.

We did a shade over $6mil in sales last year. Of course that isn't what I "made." However, my good fortune is precisely what has afforded me the luxury of time, and, it's one of the reasons that my life is as great as it is. We put in approximately 6 hour work days and, we are compensated handsomely for it, thereby affording us the luxury of spending time with family and friends. I love the ability to take a couple days off when I want, to play golf. As for goat vs. goad....My apologies. Clearly my website isn't a grammar one. It's a designer fragrance website. For those that are mocking it, not quite knowing what it means...They are designer, name brand (Gucci, Dior, Chanel, etc) perfumes and colognes. Either way, I think this has gone on long enough, don't you? Top, you know what they say... "Those who can....do..... Those who can't...teach..." My guess is you have never sold one of your candles, or anything else for that matter.

Well, I don't have a store either, only a website. And, only because you asked, yes, $2,000 would be a horrendous day for us, let alone a weekend. We averaged a little more than 8 times that much, daily, last year....since you asked.

Bruce, as I mentioned before, I have no desire to turn this into a thread, or a board, or anything else, advertising my NON candle related website. I do try to help as often as I can. I will gladly provide you with threads, in which I've posted, in an attempt to help out. Whether or not I've actually helped may be another story but, I have tried. Either way, thank you too for some of the help you provide, however, I won't be posting a url for my non-candle related website.

I am not the most experienced chandler in the world, however, I do try to give as much back as possible, sharing suppliers, and things of that nature. As for my webpage URL, it's not really applicable, as it's not a candle site in any way, shape or form. I would have a problem using this forum to advertise my site, so I won't. As for sharing what I know...I try to, as much as possible, however, as Top has so eloquently pointed out in the past, I'm FAR from the most experienced chandler on here, so, what I'm ABLE to share is somewhat limited. Bruce, by all means, you can PM me, and, I would be glad to answer any off topic questions you might have. I am always willing to help others wherever I can.

Excellent point, and one that I don't think has been discussed in this thread yet. We talked about FO load, and wax catching fire, but it's very possible that the cause of most of these is wick trimmings, at least partially.

With all due respect, your ability to "glean" is clearly out of whack, cause you have vastly underestimated me. I think that while you are clearly an experienced and knowledgable chandler (more experienced and more knowledgable than most of us), I think that sometimes your elitst attitude kind of gets in the way. It's sometimes difficult for you to give advice or opinions without sounding condescending. This isn't an insult, but rather, an observation and something that hopefully, you will take to heart. Either way, it's not a big deal, because, while you are sitting here telling me what you have "gleaned" from my posts, I'm pouring candles, taking notes, and testing testing testing. I'm the type of person that rarely goes into something without giving it their all, both in terms of monetary investment, and investment of "heart and soul." It's the very reason that I now run one of the largest, and most profitable designer fragrance websites in the world. So, while I do appreciate your advice (and I take much of it into account while trying to decide what route to take with my candles), you shouldn't pretend to "know" someone, based on information that you have "gleaned" from their posts, when, truth be told, you know nothing about me...much like I know nothing about you. If I were to judge you based strictly on information I've gleaned from your posts, I would guess that you are pompous and elitist, and the type of person who would rather "talk" or "teach" than "do." But, I don't pretend to know you, and, I'm sure you probably aren't that type of person if I knew you, in person. Either way, your advice is always appreciated, and certainly useful to most, myself included, so, keep it coming...even if it means that you feel the need to keep the attitude coming as well. Possibly, but, we can only do what we can do, and, I'm doing everything I can. I've already gone through one full pallet of my jars, strictly in testing (which I would guess is more testing than most people do). I'm not even close to finished, by the way. While it's impossible to account for everything, proper amounts of testing can account for alot, and, that's what I'm doing right now. I want to also state that I do appreciate all your advice and your sharing of knowledge on these boards, both with myself, and in general, however, I don't really know how you can possibly pretend to know "how much work I'm counting on" but, I'll humor you because of the advice that you so generously share (and I mean that).

That's very interesting. Wax getting hot enough ignites? What is the flash point of candle wax, normally? Are you sure it was the wax and not some excess fragrance oil possibly? That's a pretty horrifying story, and another example of why you SHOULD marathon burn, while testing your candles.

Received a free sample from Ergo of their 7.5 ounce frosted tumbler, in their highest end line. According to the sales rep, it was the line which had the highest concentration of fragrance oil. I let her choose which sample she was going to send, and, she sent me a Zoysia candle in that line. I could smell absolutely nothing, even when I placed this candle in a small bedroom. I'm guessing I got a dud, although, when given the choice, I'm not sure why a sales rep for the company would have sent this particular scent (given that it probably isn't their best throwing scent). For this price, however, ALL of their scents had better throw pretty darned well, and, at the very least I can say that the candle I received was horrendous in terms of throw, and, was horrendously over-wicked, with what looked to be an enormous HTP wick, in a relatively small tumbler.
