  1. At first, I was using shot glasses and measuring cups. After I emptied my first plastic FO bottle, I cut the top off and whittled it away until it weighed exactly 1/2 oz. Now, I don't bother with the tare function. I know that if I need 3 oz, I stop when it reads 3.5 oz. If I go over a bit I use a plastic droppers (www.wholesalesuppliesplus.com) to take out a bit at a time. Once I've used a dropper for a certain scent, I use a rubberband to keep it with the bottle of FO.

    Great idea!!:grin2:

  2. What are the pros and cons of click n ship and paypal shipping. I've always used the click n ship and never used the paypal shipping. Is one easier than the other? I know I can't ship parcel post with click n ship, can you using paypal shipping? Just wondering if I'm missing something. TIA

Yes you can do parcel with Paypal shipping. I do like Paypal better because I just add in the weight and the extras I want and it is done:)

  3. For those that fly under the radar, i guess good luck, but i'm sure the penalties are worse than any profit you make, and god forbid you have a lawsuit filed against you - even if you didn't do anything wrong, you probably will be held liable as a legal matter just for not registering, not to mention your insurance probably wouldn't cover you due to this and/or they'd drop you quicker than you can say doh! :tongue2:

I agree with this 100%, I really don't want to lose my house or have a lawsuit, I have kids to think about. Plus what type of reputation would my business have after a lawsuit or fines?

Thanks to everyone that responded, it makes me really happy with my decision to sell all of my B&B supplies over the weekend in the classies and just stick with my candles and tarts. Maybe another year or so of testing and I will be satisfied with my FO choices. :D

  4. It was my understanding that soap is in fact considered a cosmetic here in FL ( I could be wrong so don't shoot me:grin2: ) I don't sell anything B&B wise because with my luck they would send the swat team to my house:tiptoe:

One thing that I have done for gift baskets ordered by co-workers, friends, family is tell them up front that I can't sell any of the lotions, butters, bath teas etc. because I don't have a license or lab testing done but that I will include them as a free not for resale gift item included in the candle basket. I have one co-worker that loves my stuff and I can't afford to keep giving it away and she also knows that I can't sell it to her so she pays me for the container;) Truthfully even doing it this way makes me nervous.

That is what I am afraid of, I do not have a dedicated room for B&B, and I really don't want to be open for them coming to inspect at any time (even if I had a seperate room) I am so glad I am not the only one nervous about being caught. :undecided Your idea of the freebies is a great one. I am still not sure how to go about this all, but I know I don't want to register and I am not going to sell a full line of B&B, it is just not worth it. I really hope soap doesn't count as a cosmetic because it is addicting to make, much worse than candles!!

  5. Here are a few of the things from the site..

    (e) A cosmetic manufacturer's permit is required for any person that manufactures or repackages cosmetics in this state. A person that only labels or changes the labeling of a cosmetic but does not open the container sealed by the manufacturer of the product is exempt from obtaining a permit under this paragraph.

    c) The fee for a cosmetic manufacturer's permit may not be less than $250 or more than $400 annually.

    (5) In addition to the fee charged for a permit required by ss. 499.001-499.081, the department shall assess applicants an initial application fee of $150 for each new permit issued by the department which requires an onsite inspection.

    (6) A person that is required to register drugs, devices, or cosmetic products under s. 499.015 shall pay an annual product registration fee of not less than $5 or more than $15 for each separate and distinct product in package form. The registration fee is in addition to the fee charged for a free-sale certificate.

    (7) The department shall assess an applicant that requests a free-sale certificate a fee of $25. A fee of $2 will be charged for each signature copy of a free-sale certificate that is obtained at the same time the free-sale certificate is issued.

It goes on and on--I just love how they have it with drugs!

  6. Ok, I must be flying under the radar then. I know soap isn't regulated but I always thought if you using premade bases (lotion, shower gels, etc...) then tech. you are not "manufacturing" the product from scratch. I could be wrong which is very likely LOL. There was a thread awhile back about this but I can't find it now.

I thought that also, but have found out (and the site backs up what the county told me) that unless you buy it wholesale already packaged, labeled, etc (meaning you never even open it) you need to register it.

So we could buy a product line from another Candletech B&B maker wholesale and then sell it ourselves, but we aren't allowed to make it or even smell it LOL!!

What I would love to know is how closely it is regulated? If you go through the license search on that site, there really aren't too many registered. So I am thinking that most people are flying under the radar. I would say just keep doing what you are doing if it works for you. I know that I have had several people testing the BC lotion base for me for months and I will keep it to sell to them, just people I know.

The only reason this even came up for me was because I wanted to rent space this fall at a local craft mall (Thurs -Sun indoor market, open year round) and they need my info from registering otherwise I can't sell B&B there. Tax ID wasn't enough. They said just candles, tarts, soap that kind of thing.

My understanding is that FL is the only state with these regulations...it sucks! :undecided

    Thanks for your help :D

  7. Can anyone in Florida explain how to legally sell B&B and or cosmetics. Here is the site that lists the rules and fees...

    http://www.flsenate.gov/Statutes/index.cfm?App_mode=Display_Statute&URL=Ch0499/titl0499.htm&StatuteYear=2004&Title=-%3E2004-%3EChapter%20499

It appears to me that it would be not only expensive yearly but also a bit of a hassle (being open to inspection, testing etc)

Has anyone applied? Or are most flying *under the radar*? I know we have several members here that are in Florida so any help would be greatly appreciated:)

Also, am I correct in thinking that soap is not considered a cosmetic and not regulated since it is washed off? I would love to keep at least one product and I am addicted to making soap right now!!:tiptoe:

Feel free to pm me if you don't want to post about it here.

    Thanks!
