Using an attorney to set up LLC?

Recommended Posts

Hello everyone! :)

I am going to start operating as an LLC in the near future. I feel I have a pretty good understanding of everything I need to do and I feel confident that an LLC is the right way for me to operate as a business. Would you suggest using an attorney to set up my LLC, or go it alone? What would the advantages be of using an attorney?

It was a grand total of $82.00 in Missouri to:

  • register a fictitious name
  • LLC registration
  • get the tax license/registration established

I was able to do it all through links on the Secretary of State's website on my own.

The company I work for is owned by an attorney, and she does this type of thing every day and clients are charged $500 - $1,000 for it.

I am a legal assistant and set up LLCs and obtain Tax ID numbers often. It's so simple, no need to pay a lawyer. The Secretary of State or whatever agency is in your county/state will let you know if the name is available or not. And just make sure you pay your yearly fees (for instance, I pay franchise tax fees on my LLC each year $250).

I'm not sure if anyone has told you this, but the best state to incorporate in is Delaware. They have the most business friendly environment for you to incorporate in. There are actually a TON of companies which will even provide you with the registered agent for VERY cheaply, like 9 dollars a year.
