ubure Posted July 6, 2007 Posted July 6, 2007 Okay, it's Friday evening, I'm waiting for the wax to melt and I'm furious to the limit!!Last week I ordered about 30 whiskey tumblers I was short of from a (normally reliable) wholesaler for an important order I had to finish on last sunday to ship it on Monday so my customer gets the candles on Tuesday. They promised me to ship them immediately so I'd receive them on (last) Friday. Friday went, Monday came...still no tumblers. I called them to find out they didn't ship them at all. They promised again to send them immediately so I could have them on (last) Wednesday. Wednesday afternoon, not tumblers. In the evening they finally arrived! When I opened the box there were champagne glasses in it:confused:. I was beginnig to get a bit nervous, called them the next morning, getting a bit hysterical, threatened them with my lawyer - clear case of breach of contract they were to take the responsibility for - (after all my candles should have been at my customer's on (last) Tuesday, and I promised her to ship them today), they promised to send me the right parcel express so I would have them today in the morning.Guess what? Today the called me telling me my parcel had been sent to another city at the other side of Germany but being already on its way to me, estimated arrival at 3 pm! Okay, 1/2 hour is not enough to make another 20 candles (I would have had to ship them at 4 pm latest), but I didn't have to worry about this, because the tumblers finally arrived at 7pm. Too late for anything. Now I will have to make the candles all night in order to ship them tomorrow. I will have to pay for the extra shipping my customer has to make to her customers. Imyself have to pay for express shipping to her.I guess my lawyer will have to write a nice letter... Quote
SliverOfWax Posted July 7, 2007 Posted July 7, 2007 I guess that makes two of you who are in breach of contract, then.MORAL: Never promise something you don't have available to give.www.StuffSunshineLikes.com Quote
cybersix Posted July 7, 2007 Posted July 7, 2007 I guess that makes two of you who are in breach of contract, then. but maybe her customer didn't talk to a lawyerSliver you're right in not promising anything you don't have on hand, but if Inez already worked with that supplier and she considered it reliable it's not her fault (not talking in legal terms!), it's something that sadly can happen..Anyway the final customer can ask Inez about breach of contract but then again she will turn on the supplier who in the ends pays for everyone.. I think..Inez I have no words, I'm so sorry. I'd eat that man alive! Quote
