I was wondering, if you found a mold in the shape of a logo, would it be illegal to sell something made from it? I'll bet it would. Say you found a Disney mold and sold a tart made from it. The reason I ask is because I love the Rolling Stones and I found an ice cube tray, on line, in the shape of their tongue logo.:tongue2: If I bought it and made tarts and sold them would I be enfringing on their trademark? I'm pretty sure that is a no-no but thought I'd ask here first. Ya know, the more I think about it, I'm pretty sure it would be against the law but I'm leaving my question here just in case someone else thinks about using a trademarked mold. :wink2:

That would absolutely be an infringement of an (assumedly) registered service mark. Whether or not they would go after you for using it is another matter entirely, but you're probably safer not doing so.

Yes, that's a BIG no no.. I do custom candy wrappers and I am not allowed to use any copyright graphic for commercial use. You can use them for personal use (birthday party, baby shower.etc..) If they find out, they will go after you.. Best just not to do it and if in question don't use it.. hth

It's not so much that the band/company really cares- but it's the publicity they would stir up from it- good bad or ugly- which is why they would do it regardless of how small time you are.

A friend wanted me to make an ornie in the shape of the University of Tennessee big T. I told him I would make it if he bought the cookie cutter, cuz I sure couldn't sell them. He bought the cutter, I made the T and gave it to him as a tester.

The University of Tennessee is not likely to come after me for trademark infringement, but it's a matter of ethics.

A couple of years ago my mom was asked to make a quilt with the Arkansas mascot on it, I had to call the university and get permission from them, I cant remember which department, but i know I contacted the Dean and he told me where to get the permission.

You would need to contact the Rolling Stones publicity Department or something like that and ask their permission. They may give it to you, since you are most likely not going to make millions off the item. But if you do make lots they would probably want part of your profits.
