  2. how many eating joints have a big sign that says homemade _____ and you no good and well it aint. I'd say if you mixed and pured it at HOME ... its homemade. Are you moving form m&p to just Cp? For example wal-mart makes those inhouse homemade cookies and muffins and what have you, but the mixture is pre blended and doe is pre mixed. all they have to do is cook it.. but hey its homemade right. lol
  3. ouch bruce harsh, yes i do make candles, and am just getting into soaps. I was just asking if anyone had heard of using food coloring in candles/soaps receipes. Not that i would use it, but just wondering how the outcome was. I've read about crayons also... and if I remember corectly.. yankee candles started with a guy making candles for a present colored with crayons and other methods. thanks for your support bruce
  4. well my candles are contemperay (SP?) .... premium candles. Best of the Best:cool2: if you will. I dont wana do anything related to location or hometowns because if i grow or move, it wouldnt sound right. If i started in lets say texas and the name of bus. was texas candles and i open a shop in NC. wouldnt be a good seller. Texas candles in NC (hope you follow) I do agree now, scentsations is a very popular name, i didnt know this till i searched the internet, ouch, lol. I think that a business name is very important, and the name/logo popularity is soooo inportant and needs to be built and properly addvertised. wouldnt yall agree? i mean (just for example) people pay higher prices for Yankee candles because they think there getting a better quality product. But lets face the facts, you can get just as good candle from wal-mart if not better for half the price. Its all about the Name brand. People pay for it! im thinking something easy.... something that will stand out but not to flashy keeping it open for candles/soaps... anything that smells sorta say most of these names have been used and will most likely blend in with the others.. aroma... scentsations... heavenly scents... im guessing i should go just a plain name with like ...... candle co. candlemans candle co. lol I guess ill keep my mind open and work with it some more... this could be harder than i expected thanks for everyones replys so far

Been spending some time on what to call my candle making business and came up with Scentsations was really excited untill i did a search on the internet to find someone already has it, i wonder if they have a trademark. lol Anyways, do any of you have or can help me think of a business name. I wana keep the name open because i wana deal with anything that smells. Soaps, sprays, candles, ...... so on and so forth. any ideas or helpfull hints

  9. thats what i was talking about, yes band aid USED to be a trademark, when it first came out, but over the years every called the Bandages, band aid's making it a general trademark, and is no longer protected by the trademark laws. Because like you said, people ask for band - aid, its no longer a type or name of specific product, it is the name of the product. getting a business license and getting a trademark are seperate things. And if you dont get your trademark than your name/logo "or what have you" will not be protected expect for you general area. Like your lawyer told you, it wouldnt be a good idea to spend the money to get a trade mark, if your not playing with the big boys par-say. But on the same side someone could legaly use your same name/logo and would be breaking no laws.

  13. hey, im am by far not an expert but will try to shed some lite on the trademark issue you get a trademark to protect your PRODUCT "if you will". But the trademark has to be a protectable trademark. There are serveral catagorys of trademarks; genaric, descriptive, sugestive, fanciful. Genaric trademarks are not protectable. This is important, but sorta hard to explain, heres a breif example of a generic, non protectable trademark along time ago asprin was a trade mark, asprin was the name of acetal acid (aka asprin). But after awhile everyone called acetal acid ASPRIN. making it a generic name. Because people say,give me a asprin, not give me a acetal acid tablet.so now asprin is the name of the medicen not the trademark or logo if you will (hope you understand).now there trademark for asprin is usally the companys name like ... anways there is a office PTO patent trademark office were you can register your trademark. You dont have to register with the pto but there are extra advantages to registering. If you register your trademark is protectable all across the U.S. Non registered are only good in the general area of sale. SO if you sell in texas, the trademark is only good in texas, and someone in ... main could use the same name. You can lose your right to your trademark if you dont use it. There are a pretty good amout of rules and what have you,as you can tell. If you made lets say Joshes candles and were not registered, anyone could make candles and slap a Joshes candles logo on it and not break any trademark laws as long as they dont sell them in your same area. So if you have a pretty good business runing and want to protect your name/trademark It would be a good idea. hope i helped alittle
  14. please bare with me, i want to get started making soap, ive read the three ways of making soap m&p cold proc and hot proc and i think that cold process would be the best "if you will". I was wondering how do yall make your soap? what is the best methods for you to use. Any information would help. By chosing to go with cold process, from what i can understand i will need ess oils and LYE. Were can i buy lye? Ive looked around alittle but am having a hard time finding a site that sells it. Or can i buy it localy somewere. thanks
